1. Introduction
Welcome to EverydayWisdomOnline ("we," "us," or "our"). These Terms & Conditions ("Terms") manage your engagement with our yacht charter services and the website at everydaywisdomonline.sbs (the "Service"), run by EverydayWisdomOnline.
By reserving a charter or using our Service, you consent to be legally bound by these Terms. Should you object to any term hereof, you are refrained from using the Service.
2. Service Overview
EverydayWisdomOnline offers elite yacht charter services, which encompass a range of options:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Availability of all services is based on booking status and weather conditions. We reserve the exclusive right to adjust or cease services when necessary.
3. Booking and Reservations
3.1 Booking Process
When booking a charter, you are required to:
- Be at least 18 years of age
- Submit accurate and full details
- Provide payment for the stipulated deposit as indicated in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Confirmation of your booking happens only after payment receipt and our subsequent written confirmation. We retain the ultimate right to decline service to any individual as we see fit.
3.3 Availability
All charters are contingent upon the availability of vessels and suitable weather. Efforts will be made to meet your desired dates and times.
4. Payment Terms
4.1 Pricing
All fees are presented in € and include all applicable taxes, unless stated otherwise. Pricing may change without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the total cost of the charter, payable at the time of booking
- Balance: Payable 48 hours prior to the departure of the charter
- Any additional costs: Payable upon completion of the charter
4.3 Payment Methods
Payment methods accepted include major credit cards, bank transfers, and certified cheques. All payment processing is done using secure, encrypted methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Full refund, less any processing charges
- 24 to 72 hours before departure: Refund of 50%
- Less than 24 hours before departure: No refund is provided
5.2 Weather Cancellations
If unsafe weather conditions are determined by our captain, we propose to either:
- Reschedule the charter to another available slot at no extra charge
- Provide a complete refund if rescheduling is not possible
5.3 Mechanical Issues
Should there be mechanical issues with your assigned vessel, we will attempt to provide an acceptable replacement. If a replacement is unavailable, a full refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests are expected to:
- Adhere to all instructions from the crew
- Use any provided safety equipment when instructed
- Report any medical conditions that could affect their safety
- Remain within designated areas on the vessel
6.2 Prohibited Items
The following items are prohibited onboard:
- Glass containers
- Illegal substances
- Weapons of any kind
- Pets (unless pre-arranged)
6.3 Conduct
Guest behavior should be respectful at all times. We reserve the option to terminate a charter prematurely and without a refund if a guest's behavior is deemed as a safety concern or interrupts the experience for others.
7. Liability and Insurance
7.1 Our Liability
We are only liable up to the charter fee you paid. We hold no responsibility for:
- Personal injuries caused by passenger irresponsibility
- Loss of, or damage to, personal items
- Indirect or punitive damages, or those following on from consequences
- Delays resulting from weather or conditions outside our influence
7.2 Insurance Coverage
Our operations and vessels are covered by comprehensive marine insurance. It is your responsibility to secure personal and travel insurance.
7.3 Assumption of Risk
You acknowledge the inherent risks involved with marine activities by partaking in our charter services, accepting accountability for your personal safety.
8. Modifications and Itinerary Changes
We maintain the right to alter itineraries, paths, or schedules due to considerations like weather, safety, or operational exigencies, making every attempt to offer similar experiences.
9. Force Majeure
We cannot be held responsible for interruptions, deferrals, or changes due to events beyond our control, such as:
- Extreme weather
- Natural catastrophes
- Governmental regulations
- Port shutdowns
- Unforeseen mechanical failures
10. Privacy and Data Protection
Your private information is managed in alignment with our Privacy Policy. Utilizing our services constitutes your consent to our collection and application of your data as outlined.
11. Intellectual Property
All content on our site, including but not limited to text, imagery, and logos, is secured by copyright and trademark law. Unauthorized reproduction, distribution, or derivative creation is not permitted without our explicit consent.
12. Governing Law
The governing laws of France will apply to these Terms. Legal proceedings shall be conducted in the courts of Nice, France.
13. Changes to Terms
We have the right to revise these Terms as necessary. Changes will be showcased on our website with the revision date noted. Continued use of our services after changes indicates acceptance of the new terms.
